Stop European imperialistic aggression! Full petition text - English version

Next Thursday on the 21st of June, new negotiations between European heads of state and prime ministers will start concerning the future of the European Constitution. It will be then a little more than two years ago that the French and Dutch people rejected the constitutional proposal by referendum.

Though two founding member states expressed a negative opinion, and seven member states even haven’t got the chance to express theirs, the current German presidency of the European Union intends to pass through the European Council a ‘redrafted’ constitutional text. There are even speculations not to name the text a ‘constitution’, but rather a ‘reform treaty’. The fact on its own that this cosmetic operation needs to take place, can be questioned. Anyhow, a certain number of ‘matters of substance’ need to be rescued from the rejected constitution, according to our European leaders. These ‘matters of substance’ nevertheless imply a number of serious dangers concerning the sovereignty of the member states and its citizens. In order to indicate which dangers, we rely on the original text of the European constitution and the discussion memo of EU President Angela Merkel according to which the discussion will be held next week.

On the matter of democratic reform – especially in its traditional meaning as Pericle’s Athens knew it – the current propositions cannot satisfy us. Last week, the president of the European Commission José Manuel Barroso told British prime minister Tony Blair that he had to “stand up in front of the national public opinion” in order to accept the new treaty. It’s quite obvious that Mr Barosso’s statement is a direct declaration of war against democracy. The friendly looking mask of the European Union is falling off, behind which a horrifying monster shelters.

Although a referendum on citizens’ initiative would be made possible by the original constitution – which is a step in the right direction – it’s first of all remarkable that none of our European leaders speaks about it today. Secondly, the proposal doesn’t go far enough, since such a people’s proposal isn’t binding at all. The European Commission can draft a legal proposal according to the wishes of the European people, but isn’t obliged to do so. It would be better to make the citizens’ proposal binding.

In order not to encroach even more on the sovereignty of the member states, the Dutch government launched a proposal to introduce a ‘red card’ system. This implies that when a majority of national parliaments opposes a legal proposal of the European Commission, this proposal can be rejected. In Ms Merkel’s memo this good initiative is reduced to an ‘orange card’, which implies that a) not a simple, but a ¾-majority is needed and b) the proposal won’t be definitively rejected, but the European Commission will have to redraft a new proposal. It were better to adopt the original Dutch proposal.

A third important point is the intention to give the European Union legal personality. This provision might have far-reaching consequences, because the EU will be then able to discuss and sign international treaties concerning foreign policies, defence and judicial matters (cfr competences of the second and third pillar). There’s even a real chance that the European Union will obtain a permanent seat in the UN Security Council. It should be made clear that matters concerning foreign policy are a strict competence of the member states, in order to lay own accents on the international stage.

And then there’s still the Charter of Fundamental Rights. This charter was written as an annex added to the Treaty of Nice (2000), but hasn’t got binding legal force. It enumerates a number of ‘basic rights’, coming from typical classical freedoms such as the respect for each citizen’s private life, but also far-reaching and even far-fetched socio-economic rights and so-called rights of ‘equality’. Although it is said that making the Charter a legal binding document isn’t anything else than the confirmation of the already existing European Convention on Human Rights (after all, all member states of the EU are also member of the Council of Europe and thus bound by the ECHR) , and even letting alone whether or not the ECHR is a good thing, the EU Charter goes far beyond the existing modalities of the ECHR, as it also focuses on certain ‘social rights’ as the right on social security and social assistance. The risk that the European Union will turn in a socialistic bastion dominated by trade unions and a chubby state would get too high. And so is the risk that the European Court of Justice (ECJ) will drown in a pile of judicial cases. Considering the fierce and rightful opposition of both the United Kingdom and The Netherlands, it is said that the Charter will be left out of the new treaty (in the proposal of European constitution this charter would have formed a separate chapter with legal binding force), but at the same time one single reference would be made in order to give the charter, finally, legal binding force. Obviously, this is an obstructing trick in order to create the impression that the charter has been dropped. But it won’t be dropped at all. If there are a few member states who really which to drown in the grease of the ‘social welfare state’, they can do it on their own.

Finally we need to refer to this remarkable passage mentioned in the memo of Ms Angela Merkel: “At the same time, there is concern […] to introduce greater clarity over the delimitation and definition of competences of the Union and the member states.” Considering that the European Union mostly works with ‘shared competences’ – which means that both the EU as the member states can act on these matters – Ms Merkel’s statement possesses a real danger if a return to the principles as indicated in the European constitution would be made. After all, according to article I-12.2 the decision making competence of member states in these ‘shared competences’ would be curtailed when the EU itself would produce new legislation on the matter. Since these ‘shared competences’ include matters as environmental policy, consumer protection, social policy and fisheries, it seems obvious to us that the principle of subsidiarity – which says that a decision should be made on the level as close to the citizen as possible - is endangered.

Our conclusion is clear: the European Union has to stop absorbing more and more competences on a nontransparent way far above the knowledge of its citizens. As a result, we propose that the aim of the European summit next Thursday should be limited to ‘pragmatic’ reforms in order to make the internal kitchen of Europe more efficient (such as an end to the rotating EU-presidency and a decrease of the number of EU Commissioners). But there is no way of giving the EU more power (for example by making the charter of fundamental rights legally binding or giving the EU legal personality). The European Union also urgently needs to implement the binding referendum on popular initiative in its way of functioning. And finally a reflection whether or not some competences nowadays belonging to the so-called ‘acquis communautaire’ should be going back to a lower echelon such as the member state or – why not? – the sovereignty of each individual itself, could be salutary.

Le jeudi 21 juin prochain, il commenceront des grandes négociations entre les chefs d’état et premier ministres européens sur l’avenir de la constitution européenne. Sur ce moment, on a vécu un peu plus que deux ans après la répudiation de ce propos constitutionnel par le peuple français et néerlandais.

Bien que deux états-membres qui ont fondé l’union européenne ont donné un avis négatif, et sept autres états n’ont même pas eu la chance d’exprimer leur opinion, la présidence allemande courante de l’Union européenne semble de vouloir approuver une constitution ‘modifiée’ dans le Conseil européen. Il y a des spéculations de ne pas nommer le nouveau traité ‘constitution’, mais simplement ‘traité de réforme’. Seulement le fait qu’on a besoin de telles opérations obstructives doit être questionné. Néanmoins, quelques points qu’on considère comme « matières de base » devraient être implémentés dans le nouveau traité. Ceci comporte de toute façonne des dangers très graves qui peuvent miner la souveraineté des états membres ét leurs citoyens. Nous nous basons sur le texte original de la constitution européenne et la note de discussion d’Angela Merkel autour de laquelle les discussions auront lieu la semaine prochaine.

Sur le terrain de la démocratie – surtout dans sa version originale comme l’Athène de Périclès l’a connue – les propositions courantes ne vont pas assez loin. La semaine passée, le président de la commission européenne José Manuel Barroso disait le premier ministre britannique Tony Blair qu’il doit se résister « contre le populisme » ainsi que la Royaume-Uni approuvera le traité modifié. Ceci peut être interprété comme une déclaration de guerre contre les valeurs démocratiques. La masque de l’Union européenne est tombée par terre ; derrière laquelle il se cache un monstre horrifiant.

Bien que le texte constitutionnel original proposait la possibilité d’un référendum sur initiative populaire – ce qui est une mesure dans la bonne direction – il est très remarquable que les chefs européens se taisent sur cette matière. Ensuite, ce propos ne va pas assez loin. Par rapport au propos, la commission européenne n’est pas liée par l’initiative populaire. Elle peut garder compte avec l’opinion publique, mais n’est pas forcée de le faire. Il faudrait mieux installer la possibilité de faire des référendums populaires qui seront liables d’auprès la commission européenne.

En ordre de ne pas trop éroder la souveraineté des états-membres, le gouvernement néerlandais a récemment proposé d’introduire un système de ‘carte rouge’. Ce qui implique que quand il y a une majorité des parlements nationales, un acte législatif de la commission européenne pourra-t-être arrêté. Dans la note de discussion de madame Merkel, cette initiative salutaire est réduite vers une ‘carte orange’, ce qui veut dire que a) on n’a pas besoin d’une majorité conventionnelle mais d’une ¾-majorité et b) le propos ne sera pas repoussé, mais la commission européenne doit rédiger un nouveau propos. Il faudra mieux approuver la proposition néerlandaise.

Un troisième point concerne le propos de donner l’Union européenne de la personnalité juridique. Cette mesure pourrait avoir des conséquences lourdes, car ainsi l’UE obtiendra la compétence de négocier et signer des traités internationaux au lieu des états-membres. Il y a quand même une chance réelle que l’UE est offert une siège permanente dans le Conseil de Sécurité des Nations Unies. Il soit clair que la politique étrangère doit être une compétence exclusive des états-membres.
Et ensuite il y a encore la Charte des Droits Fondamentaux. Cette charte a été ajouté ensemble avec le Traité de Nice (2000), mais n’a pas de force juridique liable. Elle énumère une certaine nombre des ‘droits fondamentaux’, dont il y a les libertés classiques comme le respect pour la vie privée de chaque citoyen européen, ainsi que des droits socio-économiques et, ainsi nommés, des droits concernant « l’égalité ». Bien qu’on prétend que faire cette charte juridique liable n’est plus que la confirmation de la Convention européenne des droits de l'homme (car les états-membres de l’Union européenne sont aussi membre du Conseil de l’Europe, et ainsi liés à la CEDH), et hors de vue si cette CEDH était une bonne chose, la charte de l’Union européenne va plus loin, et implique aussi une grande série des ‘droits sociaux’ comme le droit de sécurité sociale et l’assistance sociale. Le risque que l’Union européenne devienne un bastion syndicaliste avec un état baignant dans la graisse est très grande. Ainsi que le risque que la Cour européen de la Justice se noiera dans les cas judiciaires. Vu que la forte et juste résistance venant de la Royaume-Uni et les Pays-Bas, on proposera de éliminer la charte hors du nouveau traité (dans la proposition de constitution européenne, cette charte deviendrait une chapitre séparée avec ( !) force juridique), mais en même temps y référer dans une petite article. Néanmoins, sur telle manière la charte obtiendrait quand même sa force juridique. A notre avis, cette charte doit être rejeté radicalement. S’il y a des états-membres qui veulent absolument se noyer dans les eaux troubles qu’on nomme ‘l’état de prospérité sociale’, ils peuvent le faire, mais seuls.

Finalement, il faut remarquer une passage bien curieuse qui se trouve dans la note-Merkel : « En même temps, on constate qu’on a besoin d’une délimitation et une définition plus claire des compétences de l’Union et ses états-membres » . Vu que l’UE a beaucoup des ‘compétences partagées’ – ce qui veut dire que l’UE ét les états-membres peuvent intervenir dans ces matières – cette détermination possède un danger réel si on retournera vers les principes comme établi dans la constitution européenne. Par rapport à l’article I-12.2, la compétence de décision pour les états nationaux sera mise en disponibilité quand l’Union européenne même décrète da la nouvelle législation. Puisque les fameuses ‘compétences partagées’ impliquent des matières comme l’environnement, la protection des consommateurs, la politique sociale et la pêche, nous sommes convaincu(e)s que ceci comporte une dérision de la principe de subsidiarité, qui dit que chaque décision politique doit être prise au niveau la proche possible au citoyen.

Notre conclusion est claire : l’Union européenne doit s’arrêter d’usurper plus en plus de compétences en employant une méthode peu transparente loin au-dessus des têtes des citoyens. Alors, nous proposons que les chefs d’état et les premier ministres qui partageront la semaine prochaine à la réunion européenne à Bruxelles se limitent jusqu’à une réforme ‘pragmatique’ qui peut tourner la cuisine interne plus efficace (comme la fin de la présidence retournant de l’UE et la réduction du nombre de commissaires européens), mais dans aucun cas déléguer plus de compétences et/ou pouvoir vers l’Union européenne (comme renforcer la charte des droits fondamentaux). L’Union européenne doit aussi installer le référendum liable sur initiative populaire, pour garantir de quelque manière la légitimation démocratique. Finalement, le Conseil européen doit réfléchir s’il n’y a pas des matières de compétence (surtout dans l’acquis communautaire) qui peuvent être déléguées vers un échelon plus bas comme l’état-membre ou même vers la souveraineté de chaque individu.

Stop Europese imperialistische agressie! Volledige petitietekst - Nederlandse versie

Volgende week donderdag 21 juni starten in Brussel grote onderhandelingen tussen Europese staats- en regeringsleiders over de toekomst van de Europese Grondwet. Het is dan iets meer dan twee jaar geleden dat de Franse en Nederlandse bevolking het voorstel tot Europese grondwet via referendum gekelderd hebben.

Hoewel twee stichtende lidstaten een negatief oordeel hebben geveld, en zeven lidstaten zelfs hun mening nog niet hebben kunnen geven, is het huidig Duits voorzitterschap van de Europese Unie van plan toch nog een ‘gewijzigde’ Europese grondwet in de Europese Raad goed te keuren. Er wordt thans gespeculeerd om het nieuwe verdrag niet meer langer ‘grondwet’ te noemen, maar gewoon een aanvulling op de reeds bestaande EU-verdragen. Het feit alleen al dat deze cosmetische obstructieoperatie dient plaats te grijpen is dubieus.Toch zouden een aantal “kernzaken” uit de weggestemde grondwet ook in dit nieuwe verdrag moeten geïmplementeerd worden. Dit houdt echter een aantal ernstige gevaren in voor de soevereiniteit van de lidstaten én haar burgers. We baseren ons op de oorspronkelijke tekst van de Europese grondwet en de discussienota van EU-voorzitter Angela Merkel waarrond volgende week zal gediscussieerd worden om aan te duiden wat.

Op het vlak van democratie – vooral in haar oorspronkelijke versie zoals het Athene van Pericles die kende – scoren de huidige voorstellen ondermaats. Vorige week nog zei Europees Commissievoorzitter Barroso tegen de Britse premier Tony Blair dat hij zich moet verzetten “tegen het populisme” en dat het Verenigd Koninkrijk zonder meer de gewijzigde grondwet/verdrag moet aanvaarden. Dit kan geïnterpreteerd worden als een duidelijke oorlogsverklaring aan de democratie. Het masker van de Europese Unie valt andermaal af, en daarachter schuilt een verschrikkelijk monster dat vooral niet wil luisteren naar wat de burger te zeggen heeft.

Hoewel de aanvankelijke constitutionele tekst voorzag in een volksraadpleging op burgerinitiatief – en dit een stap in de goede richting is – is het ten eerste opmerkelijk dat het in de hedendaagse discussie hieromtrent oorverdovend stil is, en ten tweede dat het voorstel niet ver genoeg gaat. Volgens de tekst kan de Europese burger een volksraadpleging op getouw zetten indien er minstens één miljoen handtekeningen uit verschillende lidstaten worden verzameld. Het voorstel, dat echter niet bindend is, wordt dan op de tafel van de Europese Commissie ter discussie gesteld. Dit zou beter een bindend voorstel worden.

Om de soevereiniteit van de lidstaten niet nog verder uit te hollen, heeft de Nederlandse regering onlangs voorgesteld om een ‘rode kaart’-systeem te introduceren. Dit houdt in dat wanneer een meerderheid van de nationale parlementen in de Europese Unie het niet akkoord is met een wetgevend voorstel van de Europese Commissie, dit voorstel kan tegengehouden worden. In Merkels discussienota is dit nochtans positieve voorstel afgezwakt tot een ‘oranje’ kaart, wat impliceert dat a) niet een gewone maar een ¾-meerderheid der nationale parlementen het voorstel kan tegenhouden en b) dat het voorstel niet definitief verworpen is, maar de Europese Commissie een nieuw voorontwerp dient op te stellen. Het ware beter geweest het oorspronkelijke Nederlandse voorstel aan te nemen.

Een derde belangrijk punt is het voornemen om de Europese Unie rechtspersoonlijkheid toe te kennen. Deze maatregel zou zeer verstrekkende gevolgen kunnen hebben, want hierdoor krijgt de EU ook de bevoegdheid om in naam van de lidstaten internationale verdragen te ondertekenen op het gebied van buitenlands beleid, defensie en justitiële zaken (tweede en derde pijler bevoegdheden) De kans is zelfs reëel dat de EU hierdoor permanente vertegenwoordiging in de VN-Veiligheidsraad krijgt. Het weze echter duidelijk dat het buitenlands beleid een strikte materie van de lidstaten dient te zijn, teneinde de eigen klemtonen op het internationale toneel te kunnen leggen.

En dan is er nog het Handvest van Fundamentele Rechten. Dit handvest werd als annex bij het Verdrag van Nice (2000) opgesteld, maar heeft geen bindende rechtskracht. Het somt een aantal ‘basisrechten’ op, gaande van de klassieke vrijheden zoals de eerbiediging van de privé-sfeer, maar ook verregaande sociaal-economische en zogenaamde gelijkheidsrechten. Hoewel er beweerd wordt dat het juridisch bindend maken van het Handvest niet meer is dan de bevestiging van het reeds bestaande Europees Verdrag voor de Rechten van de Mens (immers, alle lidstaten van de Europese Unie zijn ook lid van de Raad van Europa en derhalve gebonden door het EVRM), en overigens los van het feit of het EVRM op zich wel zo’n goede zaak is, gaat het EU-Handvest stukken verder, en somt het ondermeer een hele reeks ‘sociale rechten’ op zoals het recht op sociale zekerheid en sociale bijstand. Het risico dat de Europese Unie een syndicalistisch bastion met een vette overheid wordt is dan ook groot. Zo ook het risico dat het Europees Hof van Justitie overspoeld wordt met rechtszaken om de uit het Handvest voortvloeiende rechten af te dwingen. Gezien vooral de felle en terechte weerstand vanuit het Verenigd Koninkrijk en Nederland, wordt dan ook voorgesteld het Handvest uit het nieuwe EU-verdrag te laten (in het voorstel tot Europese grondwet vormde dit handvest een apart hoofdstuk mét bindende rechtswerking), maar om tezelfdertijd er in één artikeltje er een verwijzing naar te maken, zodat het toch bindende werking verkrijgt. Dit is een al te doorzichtige truk. Het Handvest, dat immers niet louter beperkt blijft tot louter civiele rechten en vrijheden, dient radicaal afgewezen te worden. Indien enkele lidstaten wensen te verzuipen in het sop van de zogenaamde ‘actieve welvaartsstaat’ doen zij dit maar alleen.

Tot slot dient er nog gewezen te worden op volgende opmerkelijke passus uit de discussienota van Angela Merkel: “Tezelfdertijd stellen we vast dat er nood is aan een duidelijkere afbakening en definitie van de bevoegdheden van de Unie en de lidstaten.” Gezien de EU vooral veel ‘gedeelde bevoegdheden’ heeft – dit betekent dat zowel de Europese Unie als de lidstaten kunnen optreden – houdt deze bepaling een reëel gevaar in indien er zou worden teruggekeerd naar de principes zoals vervat in de Europese grondwet. Immers, volgens artikel I-12.2 wordt de beslissingsbevoegdheid van nationale staten inzake deze ‘gedeelde bevoegdheden’ uitgeschakeld van zodra de EU zélf met nieuwe wetgeving op de proppen komt. Gezien de zogenaamde ‘gedeelde bevoegdheden’ zaken zoals milieu, consumentenbescherming, sociaal beleid en visserij inhouden, lijkt ons dit duidelijk een aanfluiting van het subsidiariteitsbeginsel dat stelt dat een beslissing zo dicht mogelijk op het niveau van de burger moet worden genomen.

Onze conclusie is dus helder: de Europese Unie moet ermee ophouden om op ondoorzichtige wijze boven de hoofden van de burgers steeds meer en meer bevoegdheden naar zich toe te trekken. Wij stellen daarom voor dat de top van Europese regeringsleiders zich aanstaande donderdag louter beperkt tot een zekere pragmatische hervorming die de interne Europese keuken misschien efficiënter maakt (zoals een einde aan het roterend voorzitterschap van de Europese Raad en de vermindering van het aantal leden van de Europese Commissie), maar geenszins nieuwe bevoegdheden naar zich toetrekt (zoals het juridisch bindend maken van het Handvest van Fundamentele Rechten) of haar macht versterkt (cfr. De aanname van rechtspersoonlijkheid voor de Europese Unie). Ook dient de EU het bindend referendum op volksinitiatief te installeren om haar democratische legitimiteit enigszins te waarborgen. Ten slotte dient de Europese Raad zich eerder te bezinnen of bepaalde bevoegdheidsmateries uit het zogenaamde ‘acquis communautaire’ niet beter naar een lager echelon zoals de nationale staat – of zelfs de soevereiniteit van ieder individu – wordt gedelegeerd.

Indien u ook de mening deelt dat de verdere sluipende machtsusurpatie door de Europese Unie een krachtig halt moet worden toegeroepen, voel u dan vrij deze petitie te ondertekenen. In naam der vrijheid danken wij u.
